A RESOLUTION REQUESTING THAT THE FEDERAL AVIATION ADMINISTRATION PERFORM AN ENVIRONMENTAL IMPACT STUDY REGARDING DON SCOTT AIRPORT

WHEREAS, The Ohio State University Airport is an airport owned and operated by The Ohio State University that lies to the west of the Village of Riverlea; and,
WHEREAS, The Ohio State University has proposed to expand and make certain modifications to its facility, including extension of Runway 9L/27R, installation of an Instrument Landing System on said runway, major development and expansion of corporate aviation facilities at the airport; and,
WHEREAS, the Village of Riverlea has a duty to determine the impacts, if any, which may cause disruption of an established community or may disrupt orderly and planned development, due to the significant increase in noise and surface traffic congestion that such proposed improvements may have on its citizens; and,
WHEREAS, questions regarding the thoroughness of the environmental assessment and noise impact study performed on behalf of The Ohio State University have diminished the confidence of the public in the reliability of those reports, and may indicate the construction of the proposed development might cause a significant impact on noise levels of noise sensitive areas and environment in areas surrounding the airport, including the Village of Riverlea; and,
WHEREAS, there are significant questions surrounding the cumulative impact of the proposed improvement, including its impact on existing runways and flight patterns which cannot be answered without further study;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF RIVERLEA, STATE OF OHIO, A MAJORITY OF ALL MEMBERS ELECTED THERETO CONCURRING:
Section 1. Request for Proposed Study; Request that Study Include Areas within the Village of Riverlea. That the Council of the Village of Riverlea respectfully requests The Ohio State University to join it in petitioning the Federal Aviation Administration to act in the capacity of “Lead Agency” and perform an Environmental Impact Study and assist the Airport in conducting a Part 150 Noise Study, with appropriate Noise Exposure Maps detailing the foreseeable noise contours created by the proposed airport improvements, in order that a full and fair evaluation of the proposed action, and future related actions, and the potential cumulative impacts of said improvements may be ascertained. The Council further requests that the impacts of said improvements within the Village be included as part of the Environmental Impact Study and Part 150 Noise Study.
Section 2. Notice of Resolution. That the Clerk-Treasurer of the Village be instructed to forward a duly certified copy of this Resolution to The Ohio State University Board of Trustees and The Ohio State University Airport Director, and the Council of the City of Worthington.
Section 3. Open Meetings. That this Council finds and determines that all formal actions of this Council concerning and relating to the passage of this Resolution were taken in an open meeting of this Council and that all deliberations of this Council that resulted in those formal actions were in meetings open to the public in compliance with law.
Section 4. Effective Date. That this Resolution shall be in full force and effect from and after the earliest date permitted by law.
Section 5. Publication. That pursuant to Sections 731.25, Ohio Revised Code, the Council of the Village of Riverlea hereby determines that publication of this Resolution in a newspaper is unnecessary and does hereby determine that this Resolution shall be published by posting copies hereof in the five following places which are determined to be the five most public places in the Village of Riverlea, Ohio:
- The Circle on West Riverglen Drive.
- The Ravine Park on West Riverglen Drive.
- The Northeast corner of Beverly Place and Dover Court.
- Lot 75 on West Riverglen Drive.
- Lot 7 on West Southington Avenue.
Copies of this Resolution shall be posted continuously in the above-mentioned places for a period of fifteen (15) days and at the expiration thereof this Resolution shall become effective.
WHEREUPON, this Resolution was adopted this 15th day of November, 2004.
