Village Council Resolution No. 2016-13

A Resolution To Provide Legal Council for the Village of Riverlea

WHEREAS, the village council of the Village of Riverlea deems it necessary to provide legal counsel for the Village, for its mayor and council and to provide compensation for such legal counsel during parts of the calendar years 2016 and 2017.

Therefore, Be It Resolved By The Council Of The Village Of Riverlea, State Of Ohio:

Section 1. Employment of Counsel. The Mayor of the Village of Riverlea is hereby empowered and directed to contract with L. Leah Reibel and the law firm of L. Leah Reibel LLC to provide legal counsel for the village, for its mayor and its council pursuant to Riverlea Codified Ordinances Section 31.50 and Ohio Revised Code Section 733.48, for a period beginning November 1, 2016, and ending October 31, 2017, on such terms and subject to such limitations as the Mayor and such attorneys may agree; provided, however, that such term shall include the right of the Village or such counsel to terminate such contract at the end of any calendar quarter during the term thereof on 60 days’ prior written notice.

Section 2. Payment. TIn exchange for such services, said counsel shall be compensated in the minimum sum of $12,960 per annum, and shall be compensated an additional amount for their services in any calendar month that exceed six hours at an hourly rate of $200 per hour; as well as reimbursement for their reasonable and necessary out-of- pocket costs and expenses incurred in providing such representation; provided that at no time shall any such payment exceed the amounts lawfully appropriated therefor.

Section 3. Effective Date. That this Resolution shall be in full force and effect from and after the earliest date permitted by law after its passage.

Section 4. Open Meetings. This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this Resolution were taken in an open meeting of this Council and that all deliberations of this Council that resulted in those formal actions were in meetings open to the public in compliance with law.

Section 5. Publication. That pursuant to Ohio Revised Code Section 731.25, the Council of the Village of Riverlea hereby determines that publication of this Ordinance in a newspaper is unnecessary and does hereby determine that this Ordinance, or a summary of this Ordinance, shall be published by posting copies of this Ordinance or a summary hereof in the five following places which are determined to be the five most public places in the Village of Riverlea, Ohio:

  1. The Circle on West Riverglen Drive.
  2. The Ravine Park on West Riverglen Drive.
  3. The Northwest corner of Beverly Place and Dover Court.
  4. Lot 75 on West Riverglen Drive.
  5. Lot 7 on West Southington Avenue.

Council of the Village specifically authorizes the Clerk-Treasurer, in lieu of the publication of this Ordinance and all of the attachment hereto, to publish a summary of this Ordinance and its attachment as permitted by Ohio Revised Code Section 731.21, provided that the Clerk-Treasurer shall deliver a complete copy of this Ordinance and its attachment to any person requesting the same upon payment by such person of the actual costs incurred by the Village to prepare such copy. Copies of this Ordinance or of the summary of this Ordinance shall be posted continuously in the above-mentioned places for a period of fifteen (15) days.
