A Resolution To Provide For The Acquisition Of Legal Services From Peck, Shaffer & Williams, A Division Of Dinsmore & Shohl To Serve As Bond Counsel In The Issuance Of Bonds For The Village Of Riverlea’s Water Distribution System And Street And Drainage Reconstruction Project, And To Declare An Emergency

WHEREAS, the Village of Riverlea has determined that it is in the best interests of the Village to acquire bond counsel to provide legal services for the Village of Riverlea’s Water Distribution System and Street and Drainage Reconstruction Project; and

WHEREAS, Peck, Shaffer & Williams, a Division of Dinsmore & Shohl, has proposed to provide legal services in the July 15, 2016 proposal therefore addressed to the Mayor.

Now, Therefore, Be It Resolved By The Council Of The Village Of Riverlea, State Of Ohio, A Majority Of All Members Elected Thereof Concurring That:

Section 1. Authorization. That the Mayor be and is hereby authorized and directed on behalf of the Village of Riverlea, Ohio, to enter into an appropriate Agreement with the law firm of Peck, Shaffer & Williams, a Division of Dinsmore & Shohl, to provide professional services, specifically legal services in the issuance of bonds for the Village of Riverlea’s Water Distribution System and Street and Drainage Reconstruction Project, provided that the amount expended therefor pursuant to this Resolution shall not exceed $2,980 during 2016 and 2017 without further action of Council.

Section 2. Appropriation. That the funds necessary to carry out the purposes of this Resolution have heretofore been appropriated.

Section 3. Effective Date. That this Resolution shall be in full force and effect from and after the earliest date permitted by law after its passage.

Section 4. Emergency. That this Resolution is declared to be an measure, effective upon passage, and immediately necessary for the preservation of the health, peace, safety and welfare of the residents of the Village of Riverlea. Such emergency exists in that such legal services in assistance of the acquisition of bonds could not be obtained in a timely fashion, but for the immediate effectiveness of this Resolution. Accordingly, this Resolution shall be in full force and effect from and after the earliest date permitted by law after

Section 5. Open Meetings. This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this Resolution were taken in an open meeting of this Council and that all deliberations of this Council that resulted in those formal actions were in meetings open to the public in compliance with law.

Section 6. Publication. That pursuant to Ohio Revised Code Section 731.25, the Council of the Village of Riverlea hereby determines that publication of this Ordinance in a newspaper is unnecessary and does hereby determine that this Ordinance, or a summary of this Ordinance, shall be published by posting copies of this Ordinance or a summary hereof in the five following places which are determined to be the five most public places in the Village of Riverlea, Ohio:

  1. The Circle on West Riverglen Drive.
  2. The Ravine Park on West Riverglen Drive.
  3. The Northwest corner of Beverly Place and Dover Court.
  4. Lot 75 on West Riverglen Drive.
  5. Lot 7 on West Southington Avenue.

Council of the Village specifically authorizes the Clerk-Treasurer, in lieu of the publication of this Ordinance and all of the attachment hereto, to publish a summary of this Ordinance and its attachment as permitted by Ohio Revised Code Section 731.21, provided that the Clerk-Treasurer shall deliver a complete copy of this Ordinance and its attachment to any person requesting the same upon payment by such person of the actual costs incurred by the Village to prepare such copy. Copies of this Ordinance or of the summary of this Ordinance shall be posted continuously in the above-mentioned places for a period of fifteen (15) days.
