Village Council Resolution No. 2016-05

A Resolution To Confirm the Appointment of William Charles as Street Commissioner

WHEREAS, the Mayor of the Village of Riverlea, Franklin County, Ohio, has appointed William Charles as Street Commissioner of the Village for the period beginning April 1, 2016 and continuing until March 31, 2017; and

WHEREAS, applicable law requires the Council of the Village of Riverlea to confirm such appointment for its effectiveness;

Now, Therefore, Be It Resolved By The Council Of The Village Of Riverlea, State Of Ohio, A Majority Of All Members Elected Thereto Concurring:

Section 1. Confirmation of Appointment. That the Council hereby confirms the appointment of William Charles as Street Commissioner of the Village, pursuant to the appointment to such office by the Mayor of the Village in accordance with the provisions of applicable Ohio law, to perform the duties ascribed to such office in Ohio Revised Code Section 735.32 for the period beginning April 1, 2016 and continuing until March 31, 2017. For his services in such position, William Charles shall be compensated in the amounts previously established by action of Council for the position of Street Commissioner.

Section 2. Open Meetings This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this Ordinance were taken in an open meeting of this Council and that all deliberations of this Council that resulted in those formal actions were in meetings open to the public in compliance with law.

Section 3. Emergency Effective Date That this Resolution is declared to be an emergency measure, effective upon passage, and immediately necessary for the preservation of the health, peace, safety and welfare of the residents of the Village of Riverlea. Such emergency exists in the Village because the Council meets only once a month, and three readings cannot be held before the contract expires. Accordingly, this Resolution shall be in full force and effect from and after the earliest date permitted by law after its passage.

Section 4. Publication. That pursuant to Ohio Revised Code Section 731.25, the Council of the Village of Riverlea hereby determines that publication of this Ordinance in a newspaper is unnecessary and does hereby determine that this Ordinance, or a summary of this Ordinance, shall be published by posting copies of this Ordinance or a summary hereof in the five following places which are determined to be the five most public places in the Village of Riverlea, Ohio:

  1. The Circle on West Riverglen Drive.
  2. The Ravine Park on West Riverglen Drive.
  3. The Northwest corner of Beverly Place and Dover Court.
  4. Lot 75 on West Riverglen Drive.
  5. Lot 7 on West Southington Avenue.

Council of the Village specifically authorizes the Clerk-Treasurer, in lieu of the publication of this Ordinance and all of the attachment hereto, to publish a summary of this Ordinance and its attachment as permitted by Ohio Revised Code Section 731.21, provided that the Clerk-Treasurer shall deliver a complete copy of this Ordinance and its attachment to any person requesting the same upon payment by such person of the actual costs incurred by the Village to prepare such copy. Copies of this Ordinance or of the summary of this Ordinance shall be posted continuously in the above-mentioned places for a period of fifteen (15) days.
