Ordinances Recently Adopted by the Riverlea Village Council

The Village of Riverlea recognizing the need for internal regulation adopted the ‘Code of Ordinances of the Village of Riverlea.’ These are available to our residents and to the general public on the Web site of the American Legal Publishing Corporation. This page is intended only to let our residents know of recent ordinances.

An Ordinance to Amend the Sign Ordinance of the Village. Introduced 03-18-2013

WHEREAS, the Village of Riverlea has determined that the appropriate regulation of outdoor signage within the Village will promote the health, safety and welfare of the Village and its residents by the limitation of the distractions provided by such signage for vehicular traffic within the Village, thereby promoting the safety of pedestrians, in a minimally obtrusive manner, and will permit residents to post desired signage in the Village;

WHEREAS, Council for the Village has determined that clarifying the ordinances of the Village regarding signage will benefit the residents of the Village.

Be it ordained by the Council of the Village of Riverlea, State of Ohio:

Section 1. Confirmation of Signs

That Riverlea Code Section 152 is hereby amended by adding a purpose section in the introduction:

The purpose of this chapter is to control and regulate signs to prevent them from becoming a nuisance factor to adjacent properties and the community in general, as well as to protect from distractions and obstructions that can contribute to traffic and pedestrian accidents. To protect the general health, safety and welfare, and to protect and encourage a more attractive overall physical appearance of the community, all signage is subject to the regulations that follow in this chapter.

That Riverlea Code Section 152.03(A) and 152.03(C) are hereby amended to remove the 10 foot sign restriction; however other sections remain as currently written, and read:

152.03 Prohibited Sign Locations

Signs may not be installed or maintained in any of the following locations in the village:

  1. On or above the paved portion of any street;
  2. In any public park or other public property, except that this restriction shall not prohibit the placement of otherwise permitted or unregulated signs in the unpaved portions of street right-of-way;

That Riverlea Code Section 152.05(D) is hereby amended to increase the garage sale sign time limit from one day before the sale until three days before the sale, however other sections remain as currently written:

152.05 Special Provisions

  1. Garage Sale Signs. Garage sale signs shall be located only on the property hosting the sale. Garage sale signs shall be permitted three days before the day of and on the day of the garage sale. Directional signs designating the location of a garage sale may be located in the unpaved right-of-way areas on village thoroughfares on the day of the event. Not more than 5 signs advertising a garage sale, one garage sale sign and four directional signs relating to a garage sale are permitted.

Section 2. The Statutes to be Amended.

That pursuant to the requirements of Sections 731.19, Ohio Revised Code, the existing Riverlea Code Sections 152.03 and 152.05, which are amended by Section 1 above, is hereby set forth:

§ 152.03 Prohibited Sign Locations.

Signs may not be installed or maintained in any of the following locations in the village:

  1. On or above the paved portion of any street or within ten feet of any street curb;
  2. In any utility easement or no-build zone maintained for public or private utilities;
  3. In any public park or other public property, except that this restriction shall not prohibit the placement of otherwise permitted or unregulated signs in the unpaved portions of street right-of-way that are not closer than 10 feet to any curb or paved street;
  4. On any traffic-control signs, construction signs, fences, utility poles, street signs, bulletin boards, trees or other natural objects;
  5. any location where the view of approaching and intersecting traffic would be obstructed. No sign shall be located so as to interfere with the safe movement of vehicles or pedestrians entering, leaving, or crossing a public right-of-way;
  6. (F) On any property without the prior authorization granted by the property owner on which any sign is to be placed.

§ 152.05 Special Provisions.

In addition to the other restrictions contained in this chapter, the following additional provisions shall apply to the types of signs described in this section:

  1. Real Estate Signs. For Sale/For Lease signs shall be located only on the property offered for sale or rental. Signs advertising the sale of real estate shall not remain longer than one week following the closing of the sale of such property. Open house signs shall be permitted only on those days when the property is open for inspection. Not more than 5 signs advertising an open house, one open house sign and four directional signs relating to an open house are permitted.
  2. Development Signs. Total display area of development signs shall not exceed 32 square feet. Development signs shall be permitted only during the period of substantially continuous construction or activity, together with a period of time both before and after such activity that aggregates no more than 30 days; provided that no development signs shall be maintained for a period longer than one year. Only one sign per project is permitted.
  3. Security System Signs. Signs displaying information about the security system protecting buildings or property shall be permitted, provided that such signs do not exceed one square foot in area.
  4. Garage Sale Signs. Garage sale signs shall be located only on the property hosting the sale. Garage sale signs shall be permitted only one day before the day of and on the day of the garage sale. Directional signs designating the location of a garage sale may be located in the unpaved right-of-way areas on village thoroughfares on the day of the event. Not more than 5 signs advertising a garage sale, one garage sale sign and four directional signs relating to a garage sale are permitted.

Section 3. Effective Date. That this Ordinance shall take effect from and after the earliest date permitted by law.

Section 4. Open Meetings. This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this Ordinance were taken in an open meeting of this Council and that all deliberations of this Council that resulted in those formal actions were in meetings open to the public in compliance with law.

Section 5Publication. That pursuant to Ohio Revised Code Section 731.25, the Council of the Village of Riverlea hereby determines that publication of this Ordinance in a newspaper is unnecessary and does hereby determine that this Ordinance shall be published by posting copies hereof in the five following places which are determined to be the five most public places in the Village of Riverlea, Ohio:

  1. The Circle on West Riverglen Drive.
  2. The Ravine Park on West Riverglen Drive.
  3. The Northwest corner of Beverly Place and Dover Court.
  4. Lot 75 on West Riverglen Drive.
  5. Lot 7 on West Southington Avenue.

Copies of this Ordinance shall be posted continuously in the above-mentioned places for a period of fifteen (l5) days.Passed this ____ day of _______, 2013.
