Regular Council Meeting

October 19, 2015

The Council of the Village of Riverlea met on the above date at the Thomas Worthington High School, Worthington. The following Council members were present: Mayor Kirk M. McHugh, Michael A. Blanchard, Scott K. Gordon, Jenny D. Jones, Eric A. MacGilvray, and Josh Schoenberger. Also present were Joshua C. Mehling, Clerk-Treasurer, L. Leah Reibel, Solicitor, Jody Croley Jones, Web Manager, Carolee Noonan, Planning Commissioner, and William P. Charles, Street Commissioner. At 8:18 pm the Mayor called the meeting to order.

Minutes

  1. The minutes of the regular Council meeting of September 21, 2015 were not read since each member had received a copy. Jones moved and Schoenberger seconded the motion that the minutes be approved as submitted by the Clerk-Treasurer. The motion carried (5-0).
  2. The minutes of the special Council meeting of October 11, 2015 were not read since each member had received a copy. Blanchard moved and Gordon seconded the motion that the minutes be approved as submitted by the Clerk-Treasurer. The following vote was recorded on the motion: Yes, 4 – Blanchard, Gordon, MacGilvray, Schoenberger; No, 0; Abstain, 1 – Jones. The motion carried (4-0-1).

Report of the Clerk-Treasurer

  1. Jones moved and Schoenberger seconded the motion to approve the payment of bills and to accept the financial reports for September 2015 as submitted by the Clerk-Treasurer. The motion carried (5-0).

Report of the Mayor

  1. The Mayor reported that he used his personal funds to purchase and plant a Blue Spruce tree on the edge of the ravine for use by the village as a holiday tree.
  2. The Mayor reported that he had spoken with Jason Galloway, who has been clearing the ravine. There has been a noticeable improvement in the looks of the ravine since he started this work. Mr. Galloway suggested that when the village works with Franklin County to help residents purchase trees for planting in their yards, that the residents may want to purchase a second tree for planting in the ravine, and that he would take responsibility for planting these. The Mayor stated that the Village should officially thank Mr. Galloway for the work he has performed on behalf of the village and possibly offer him an official position with the Village
  3. The Mayor asked if anyone knew the resident who had sent emails to Council on the Village communications. The last email from the resident had implied the threat of legal action. Most of the Council members had not seen the latest email and the Mayor said that he would send it out.

Report of the Solicitor

  1. The Solicitor reported that she had researched whether the Village had the right to regulate people picking through the trash of Village residents. She stated that it was a possibility and that various local municipalities have taken differing stances on the issue. Worthington allows trashpicking, but Upper Arlington has an ordinance against this. She stated that the Village already has an ordinance against dumping and anything considered litter, so anyone dumping refuse into the ravine could be prosecuted under this ordinance. Jones questioned whether Worthington Police could patrol the Village more on days when the trash is out in yards to deter any illicit activity. The Mayor stated that he could ask this question to the Worthington Chief of Police in November, when he will be in attendance at the Council meeting.
  2. The Solicitor stated that James Mosic, the Worthington Chief of Police, will be in attendance at the November Council meeting. The 2016 contract for Police services will be up for discussion and he would like to discuss any issues the Village may have with Council.

Report of the Street Commissioner

  1. The Street Commissioner reported that he had submitted the stormwater management plan. He sent it to the Web Manager to post on the web for public comment.
  2. The Street Commissioner asked Blanchard if he knew anyone who would be interested in installing three new street signs to replace ones that had been removed for various reasons. Blanchard replied that he could take care of this installation. The Mayor asked Blanchard if he could also look at the burned out light at the Village entrance on Southington, and he stated that he would.
  3. The Street Commissioner reported that Jim Dippel with Burgess and Niple had stated that the contractor in charge of the stormwater outfall repair would be bringing in the contracts for signing the next day. The Commissioner stated that he had heard from Schoenberger on the prevailing wage issue with the repair work and that the Village needed to conduct a site survey to confirm that the workers are making a prevailing wage. Schoenberger offered to provide any help necessary on this.

Report of the Planning Commissioner

  1. The Planning Commissioner reported that there was no meeting in October, but that there had been a resident who had asked and been approved for a driveway replacement.

Report of the Marshal

  1. There was no report from the Marshal.

Report of the Web Manager

  1. The Web Manager reported that there had been several updates to the web site, with all of the recent activity in the village. She stated that the email list for the Village had not been updated in some time and that the Council should consider putting together an email list for news. She stated that she would put a form up on the site and ask people to sign up.

  1. Committee on Infrastructure
    There was no report from the Chair of the committee.
  2. Resolution 2015-15
    Resolution 2015-15, A Resolution to Request that the City of Columbus Place a “Closed at Dusk” Sign at Rush Run Park was given its third reading. Blanchard moved and Schoenberger seconded the motion to adopt this resolution. The motion passed unanimously (5-0).
  3. Ordinance 09-2015
    Ordinance 09-2015, An Ordinance Enacting and Adopting a Supplement to the Code of Ordinances for the Village of Riverlea, Ohio was introduced by Jones and given its second reading.

New Business

  1. Resolution 2015-16
    Resolution 2015-16, A Resolution to Provide Legal Counsel for the Village of Riverlea was introduced by Gordon. Gordon moved and Blanchard seconded the motion to waive the three readings of this resolution in order to have this contract take effect upon the expiration of the current contract at the end of the month. The motion passed unanimously (5-0). Jones moved and Blanchard seconded the motion to adopt this resolution. The motion passed unanimously (5-0).
  2. Resolution 2015-17
    Resolution 2015-17, A Resolution Accepting the Amounts and Rates as Determined by the Budget Commission and Authorizing the Necessary Tax Levies and Certifying them to the County Auditor was introduced by Schoenberger. Jones moved and Blanchard seconded the motion to waive the three readings of this resolution in order to submit this to the county by the end of the month. The motion passed unanimously (5-0). Jones moved and Schoenberger seconded the motion to adopt this resolution. The motion passed unanimously (5-0).
  3. Ordinance 11-2015
    Ordinance 11-2015, the Annual Appropriation Ordinance was introduced by Gordon and given its first reading.
  4. Expenses
    There were no expenses to approve for the month.

Next Meeting Announcement

The Village will hold a second public forum to discuss the ballot issues on Monday November 16 at 7:00 at the Thomas Worthington High School. The regularly scheduled Council meeting will be held following this forum.

There being no further business, Jones moved and Schoenberger seconded the motion to adjourn. The motion was approved unanimously (5-0). The meeting was adjourned at 8:45 pm.
