Public Information

Architectural Review Board (ARB) meetings are held on the second Monday each month at 7:00 pm, pending the need to meet. The ARB does not do building inspection, only architectural review and zoning compliance. All Village residents are welcome and encouraged to attend the meetings.

Regular meeting: October 11, 2009

A meeting of the Village of Riverlea Planning Commission was held October 12, 2009 at 5830 Falmouth Court. Members present were Michael Jones (Planning Commissioner), L. Keith Beachler and Lisa J. Morris. Jody C. Jones and Bryce E. Jacob were absent. Also present were Bruce Paul, Kim Bahr, Sue White, Diane Hitt, Tom Van Cleef and Kent Anders. Pamela M. Colwell served as Clerk. The Planning Commissioner called the meeting to order at 7:30 pm.

  1. The minutes of the Planning Commission meeting of September 14, 2009 were not read since each member had received a copy. Morris moved and Beachler seconded a motion that the minutes be approved as submitted by the Clerk-Treasurer. The following vote was recorded on the motion: Yea, 3; Beachler, Morris and M. Jones: Nay, None. The Motion carried 3-0.
  2. An application for a Variance and Certificate of Appropriateness by William and Tracey Hale at 44 West Riverglen Drive for a 48 inch high ornamental iron fence to enclose the back yard. The variance is for the fence height. Beachler moved and Morris seconded the motion to approve the variance for the 48â€� fence height. The Commissioner stated that Council has asked the Village Solicitor to draft an ordinance to change the standard fence height for the Village from 42 inches to 48 inches and, therefore, he had no objection to the height. Morris and Beachler agreed with him. The following vote was recorded on the motion: Yea, 3; Beachler, Morris and M. Jones: Nay, None. The Motion carried 3-0.

    Morris moved and Beachler seconded a motion to approve the Certificate of Appropriateness for a black ornamental fence per the plans submitted. The Commission said the plans were very well done. The following vote was recorded on the motion: Yea, 3; Beachler, Morris and M. Jones: Nay, None. The Motion carried 3-0.

  3. An application for a Variance and Certificate of Appropriateness by Bruce Paul at 215 West Southington Avenue for an addition to the south side of the existing garage and a paver patio with a pergola on the west side of the garage. A variance is needed for the rear and a second variance is needed for the side of the addition. The property is 150.8′ deep and the rear setback is supposed to be15% of the depth of the lot, which equals a required 22.5′ rear setback per the ordinances. The required side setback is 10′. The existing garage is 5′ from the side property line. The next door neighbor to the east has a garage that sits within 10′ of the back property line. This addition would not go back as far as that neighbor’s garage. Beachler moved and Jones seconded a motion to grant the variance for the 5′ setback for the side yard and a variance for the 12′ setback for the rear yard per the plans submitted. The following vote was recorded on the motion: Yea, 3; Beachler, Morris and M. Jones: Nay, None. The Motion carried 3-0.

    All of the materials to be used for the addition and patio will be the same as or will match the existing materials and color. The pergola will be made of treated lumber and will not be painted. Standard glass French doors and standard double hung windows, off-white in color, will be used for the side of the garage. Beachler moved and Morris seconded the motion to approve the Certificate of Appropriateness for the garage addition, pergola and paver patio as submitted including the comments and notations made on the plans. Residents in attendance expressed their approval of the plans with no reservations. The following vote was recorded on the motion: Yea, 3; Beachler, Morris and M. Jones: Nay, None. The Motion carried 3-0.

The Commission took no additional action. Beachler moved and Morris seconded a motion to adjourn. The following vote was recorded on the motion: Yea, 3; Beachler, M. Jones and Morris: Nay, None. The Motion carried 3-0. The meeting was adjourned at 7:55 pm.
