REGULAR COUNCIL MEETING
NOVEMBER 20, 2006

THE COUNCIL OF THE VILLAGE OF RIVERLEA MET ON THE ABOVE DATE AT 215 WEST RIVERGLEN DRIVE. THE FOLLOWING COUNCIL MEMBERS WERE PRESENT: MARY JO CUSACK, MAYOR; PAMELA M. COLWELL; SCOTT K. GORDON; JOHN A. SCHAER; RENEE SHANNON, RODNEY TETTENHORST AND PAUL J. ZENISEK. ALSO PRESENT WERE GARY A. BRUCK, BUILDING/ZONING COMMISSIONER; DANIEL A. MCINTYRE, STREET COMMISSIONER; STEVEN W. MERSHON, SOLICITOR; NEIL R. MORTINE, MARSHAL; DAN E. OWENS, CLERK-TREASURER AND LOIS YOAKAM, NEWSLETTER EDITOR. ANDREW A. GARDNER OF CF BIRD + RJ BULL INC AND LIEUTENANT MICHAEL P. DOUGHERTY OF THE WORTHINGTON POLICE DEPARTMENT WERE GUESTS OF COUNCIL. THE MAYOR CALLED THE MEETING TO ORDER AT 7:32 P.M.

MR. GARDNER REPORTED ON THE CONDITION OF VILLAGE STREETS AND HOW THEY WOULD CONTINUE TO DETERIORATE, IF NOT RESURFACED. HE OUTLINED THE SPECIFICATIONS THAT SHOULD BE USED AND THE THICKNESS TO BE REMOVED. DRAINAGE FROM BASEMENT SUMPS AND ROOFS WAS DISCUSSED. THE POSSIBILITY OF USING CONCRETE PAVEMENT INSTEAD OF AN ASPHALT SURFACE WAS TO BE INVESTIGATED.

IN REPLY TO A LETTER FROM THE MAYOR, LT. DOUGHERTY EXPLAINED WHY THE WORTHINGTON POLICE DEPARTMENT WAS NOT ENFORCING THE PARKING RESTRICTIONS ON WEST SOUTHINGTON AVENUE NEAR NORTH HIGH STREET INVOLVING CONSTRUCTION VEHICLES. HIS POINT WAS THAT IT WAS A TEMPORARY AND NECESSARY INCONVENIENCE. WARNINGS AND CITATIONS FOR EXTENDED PARKING AND THE DUMPING OF CONSTRUCTION MATERIALS IN THE VILLAGE STREETS WAS DISCUSSED.

BOTH GUESTS EXITED THE MEETING.

MINUTES OF THE REGULAR COUNCIL MEETING OF OCTOBER 16, 2006, WERE NOT READ SINCE EACH MEMBER HAD RECEIVED A COPY. THE DATE IN THE PARAGRAPH FOLLOWING “NEXT MEETING AND ADJOURNMENT” WAS CORRECTED TO READ “NOVEMBER 20, 2006”. SCHAER MOVED AND COLWELL SECONDED A MOTION THAT THE MINUTES BE APPROVED AS CORRECTED. SHANNON MOVED AND COLWELL SECONDED A MOTION THAT THE MINUTES BE APPROVED AS CORRECTED. THE FOLLOWING VOTE WAS RECORDED ON THE MOTION: YEA, 6; COLWELL, GORDON, SCHAER, SHANNON, TETTENHORST AND ZENISEK: NAY, NONE. THE MOTION CARRIED 6-0.

SCHAER MOVED AND ZENISEK SECONDED A MOTION TO APPROVE THE PAYMENT OF BILLS AND TO ACCEPT THE FINANCIAL REPORT FOR OCTOBER OF 2006, AS SUBMITTED BY THE CLERK-TREASURER. THE FOLLOWING VOTE WAS RECORDED ON THE MOTION: YEA, 6; COLWELL, GORDON, SCHAER, SHANNON, TETTENHORST AND ZENISEK: NAY, NONE. THE MOTION CARRIED 6-0. SEE BOARD REFERRAL FILE NUMBER 06-017.

THE CLERK-TREASURER COMMENTED ON THE PROGRESS OF THE AUDIT OF THE VILLAGE’S BOOKS BEING CONDUCTED BY THE AUDITOR OF STATE AND THE NEED FOR THE INVESTMENT AND AUDIT COMMITTEE TO MEET BEFORE THE DECEMBER MEETING OF COUNCIL TO COMPLETE THE DRAFT OF THE APPROPRIATION ORDINANCE (VILLAGE) FOR CALENDAR YEAR 2007.

REPORTS OF OFFICIALS

THE MAYOR REPORTED THAT PARKING ON CURBS APPEARS TO NO LONGER BE A PROBLEM IN THE VILLAGE. A REVIEW OF DOCUMENTS RELATING TO THE FEDERAL FLOOD INSURANCE PROGRAM SEEMS TO INDICATE THAT THE PROGRAM DOES NOT CONCERN THE VILLAGE. RIVERLEA IS TO DELEGATE ITS DISASTER PROGRAM TO THE WORTHINGTON POLICE DEPARTMENT. WORTHINGTON MAY ROUTE THEIR HOLIDAY SHUTTLE BUS THROUGH THE VILLAGE.

THE SOLICITOR REPORTED THAT DON SCOTT AIRPORT’S AIRSCENE SYSTEM IS OPERATIONAL. NOISE COMPLAINTS CAN BE REGISTERED BY PHONE, E-MAIL AND IN THE NEAR FUTURE AT OSUAIRPORT.ORG. THE SOLICITOR REPORTED HAVING PREPARED A ORDINANCE AND A RESOLUTION FOR CONSIDERATION BY COUNCIL.

THE BUILDING/ZONING COMMISSIONER REPORTED ONE REQUEST FOR A VARIANCE WAS WITHDRAWN AND THE CERTIFICATE OF APPROPRIATENESS WAS APPROVED. MEMBERSHIP ON THE PLANNING COMMISSION REMAINS UNDER CONSIDERATION.

THE MARSHAL REPORTED 285 PATROL CHECKS, 6 COMPLAINTS FILED AND NO ARREST DURING OCTOBER.

THE STREET COMMISSIONER REPORTED 10 TREES WILL BE PLANTED NEAR THE END OF THE MONTH. HE STATED THAT THE SEWERS HAVE NOT BEEN CLEANED DUE TO THE WEATHER. STREETS CAN BE SWEPT ONCE LEAVES ARE REMOVED. YOUTHS HAVE BEEN REPORTED RIDING BIKES ON THE SIDE HILLS OF THE RAVINE AND THE STREET SIDE AMERICAN FLAGS HAVE BEEN MOVED AND STAFFS BROKEN; BOTH ISSUES ARE TO BE REPORTED IN THE NEWSLETTER.

THE WEBMASTER HAD NO REPORT. COUNCIL REQUESTED THAT THE FIRST FEW PAGES OF THE DIRECTORY BE PLACED ON THE WEB SITE. RESIDENTS ARE REPORTED HAVING PROBLEMS ACCESSING THE VILLAGE’S WEB SITE USING APPLE COMPUTERS.

AFTER SOME DISCUSSION, SCHAER MOVED AND GORDON SECONDED A MOTION TO SUSPEND THE THREE READINGS OF ORDINANCE NO. 06-06. THE FOLLOWING VOTE WAS RECORDED ON THE MOTION: YEA, 5; COLWELL, GORDON, SCHAER, SHANNON AND ZENISEK: NAY, NONE: ABSTAIN, 1; TETTENHORST. THE MOTION CARRIED 5-0-1. A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH THE CITY OF COLUMBUS FOR LEGAL REPRESENTATION IN CERTAIN CRIMINAL AND TRAFFIC CASES WAS READ, BY TITLE, FOR THE SECOND TIME.

AN ORDINANCE ENACTING AND ADOPTING A SUPPLEMENT TO THE CODE OF ORDINANCES FOR THE VILLAGE OF RIVERLEA, OHIO, AND DECLARING AN EMERGENCY WAS READ, BY TITLE, FOR THE SECOND TIME.

AN APPROPRIATION ORDINANCE (VILLAGE) FOR CALENDAR YEAR 2007 WAS READ, BY TITLE, FOR THE SECOND TIME.

COLWELL WILL PRESENT THE DRAFT OF THE ZONING AND PROPERTY MAINTENANCE REPORT AT THE DECEMBER MEETING OF COUNCIL.
